1. Acceptance of these terms
By visiting our website, requesting a quote, purchasing a service, or engaging Wix Web Design Expert for a project, you acknowledge that you have read and agree to these Terms & Conditions, together with any proposal, invoice, scope of work, or other written agreement applicable to your project.
2. Independent service provider
Wix Web Design Expert is an independent website design and development studio. We are not affiliated with, sponsored by, endorsed by, or officially connected with Wix.com Ltd. or any of its subsidiaries or affiliates. "Wix" is a registered trademark of its respective owner and is used solely to describe the platform on which our services may be delivered.
3. Scope of services
Services are scoped and quoted individually based on the package, proposal, or custom brief agreed with the client in writing before work begins. The agreed scope may include website design, website development, redesign, migration, e-commerce setup, booking setup, custom programming, maintenance, support, branding, digital marketing, or related services.
Requests that fall outside the agreed scope, materially change the original requirements, or require additional work may be quoted and billed separately.
4. Client responsibilities and project information
The client is responsible for providing complete and accurate project requirements, content, approvals, credentials, feedback, and other information reasonably required to complete the project. If information or project scope is incomplete, delayed, or materially changed after work has started, delivery dates and commitments may be adjusted accordingly.
5. Client account and third-party fees
Unless specifically included in a written proposal, our fees cover the services and labor described in the agreed scope. Wix subscriptions, domains, premium apps, payment processing fees, stock assets, licensed software, advertising spend, or other third-party products and services are the client's responsibility and may be billed directly by the applicable provider.
6. Payments
Payment terms will be stated in the applicable proposal, invoice, package, or written agreement. Unless otherwise agreed, a deposit may be required before work begins and the remaining balance may be due before launch, handover, or final delivery.
A project will not be considered delayed or void because work is paused while an agreed or invoiced payment remains outstanding. Delivery commitments are dependent on payments being made according to the agreed schedule.
7. Revisions and changes in scope
Each package or project may include a defined number of revision rounds within the original agreed scope. Additional revisions, new features, substantial redesign requests, or changes in direction may be treated as additional work and quoted separately.
8. Delivery policy
Our delivery commitments depend on timely payments, timely communication, and complete project information from the client. Wix Web Design Expert is not responsible for delays caused by missing content, delayed approvals, incomplete requirements, unavailable access credentials, third-party service issues, or other circumstances outside the agreed project responsibilities.
No compensation for a delivery delay will be due unless a separate written agreement expressly includes a specific delay-related penalty or compensation clause.
9. Complaints and dispute resolution
We believe every project should begin with a clear finished result in mind. If a client is dissatisfied with any part of a service, both parties should first make reasonable efforts to reach a mutually acceptable solution before a refund or cancellation is pursued.
Clients considering a refund claim should first contact us at hello@wixwebdesignexpert.com with the relevant project details so the issue can be reviewed and an attempt can be made to resolve it.
10. Cancellations and refund eligibility
Refund requests are considered only after reasonable attempts have been made to resolve the underlying project issue. Reasons unrelated to the services provided, including a change of mind, disagreement with a business partner, or a decision not to continue with the project for personal or business reasons, do not automatically qualify for a refund.
Where a project has not been completed in accordance with the agreed scope and applicable delivery commitments, a partial refund may be considered based on the proportion of contracted work that remains incomplete. Any refund is subject to the applicable project agreement and our Refund Policy.
11. Custom programming and development
For application programming, custom development, integrations, or similar technical work, refund eligibility is assessed against the agreed scope, completed milestones, work already delivered, and work remaining. Refunds will not be issued solely because of a change of mind or circumstances unrelated to the quality or delivery of the contracted service.
12. Dedicated hiring and ongoing resource services
If a client cancels a dedicated hiring, retained resource, or similar ongoing service, any eligible refund will be calculated proportionately where applicable. No refund will be provided for time, days, or work already completed by the assigned resource.
If the client is dissatisfied with ongoing work, the client should notify the Project Manager or our team promptly so the concern can be addressed while the work is active. Requests for retrospective discounts or adjustments may not be accepted where the concern was not raised within a reasonable time.
13. Ownership and project materials
Once all applicable project fees have been paid in full, the client owns the final client-specific content and design deliverables transferred to the client's account, subject to any third-party licenses. Pre-existing tools, frameworks, templates, reusable components, internal processes, code libraries, and other materials owned or licensed by Wix Web Design Expert remain the property of their respective owners.
14. Limitation of liability
To the extent permitted by applicable law, Wix Web Design Expert's liability relating to an incomplete project is limited to the value of the portion of the contracted project that remains incomplete. Wix Web Design Expert will not be responsible for indirect losses arising from services delivered, services not delivered, project delays, third-party platforms, or circumstances outside our reasonable control.
Any liability to issue a refund arises only after an eligible cancellation or refund has been reviewed and communicated in writing in accordance with the applicable agreement and Refund Policy.
15. Processing of approved refunds
Approved refunds will be processed within 5 business days of the applicable cancellation or refund approval date and will normally be issued using the same method of payment used for the original transaction, unless otherwise agreed in writing.
16. Updates to these terms
Wix Web Design Expert may update these Terms & Conditions from time to time to reflect changes in our services, business practices, or legal requirements. Updated terms will be posted on this page with a revised "Last updated" date.
